Terms and Conditions

1. Definitions

  1. General Terms and Conditions: The general terms and conditions used by MengjiaMindfulness are published on the MengjiaMindfulness website: www.mengjiamindfulness.com.
  2. Additional Terms and Conditions: the additional general terms and conditions applicable to the Program, Therapy, Group sessions, Workshops, and Ceremonies offered or hosted by MengjiaMindfulness.
  3. MengjiaMindfulness: MengjiaMindfulness is a business registered with the following details at the Dutch Chamber of Commerce:

    • Bank account number: NL71KNAB0775839256
    • Mengjia is also a CAT therapy registered under BO nr.: 131352024-09-20
  4. Participant: the person who attends or wishes to attend any services offered by MengjiaMindfulness.
  5. Services: the services include all offerings made by MengjiaMindfulness, namely the Program, Therapy, Group sessions, Workshops, and Ceremonies, as well as other events offered or hosted by MengjiaMindfulness.
  6. Sessions: the services of MengjiaMindfulness are mostly offered by Sessions, with a duration that varies per service.
  7. Price: the total price of any services offered by MengjiaMindfulness.

2. Scope of Application

  1. The General Terms and Conditions apply to any Participants who have purchased the services offered by MengjiaMindfulness.
  2. By participating in a Program, Therapy, Group session, Workshops and Ceremony, as well as other events offered or hosted by MengjiaMindfulness, the participant agrees to the applicability of these General Terms and Conditions.
  3. MengjiaMindfulness may from time to time amend these General Terms and Conditions. The most recent version of the Terms and Conditions is always the version that is applicable and is always available on the Website.

3. Payment and Price Changes

  1. All sessions and events organized by MengjiaMindfulness must be paid for before they are held. Payments can be made by direct debit, PIN, Credit Card (Visa, Master Card) and iDeal.
  2. MengjiaMindfulness reserves the right to change the pricing of all Services. Any changes are announced in advance by putting, by placing statements on the Website, and/or by email. The currently applicable rates are always mentioned on the Website.
  3. Shipping costs, times and fees do not apply to MengjiaMindfulness. 

4. Reservations and cancellations for sessions

  1. All sessions are available for online booking minimum 14 days in advance.
  2. When a group session is fully booked, the Participant can sign up for the Waiting List. If a spot opens up, the first Participant to book the session through the schedule will be notified by email.
  3. Non-attended sessions are not refunded.
  4. Rescheduling an appointment for a private session can be done without charge up to 24 hours before the start of the appointment. The Participant will be charged in full if the private appointment is cancelled within 24 hours before the start of the appointment.

5. Schedule

  1. The current schedule is mentioned on the Website. MengjiaMindfulness reserves the right to change the schedule at any time. If possible, any changes are announced in advance by putting mentioning them on the Website or by email.
  2. MengjiaMindfulness reserves the right to cancel a session that has been scheduled or to change the teacher/instructor mentioned in the schedule in the event of force majeure, including illness of the teacher. In the case of the replacement of a teacher, there will be no refund of any course fee.
  3. MengjiaMindfulness reserves the right to close its doors on public holidays or other days, or when imposed by the government, in case of force majeure, national safety or a pandemic.

6. Early Termination of Services in case of illness

  1. In the event of prolonged illness or an injury, the Participant may terminate the Services early. A request for early termination must be submitted to MengjiaMindfulness in writing and MengjiaMindfulness reserves the right to evaluate and handle each case individually. This termination may be sent by email to mengjiamindfulness@gmail.com

7. Liability

  1. Attending any Sessions and leaving belongings at the event location is at the Participant’s risk. MengjiaMindfulness accepts no liability for the loss or damage of personal belongings. If during a Session the Participant causes loss or damage to the venue’s property, this person will be held liable. This loss or damage is in no way covered by MengjiaMindfulness. The Participant is considered to have the right insurance to cover this loss or damage.
  2. MengjiaMindfulness is not in any way liable for personal injuries sustained during a session. Participating is always at the own risk of the Participant.
  3. MengjiaMindfulness provides the following guidelines for reducing the risk of an injury:

General rules

  1. Always consult a doctor before starting any session if you are not sure that you are healthy and safe to participate.
  2. If you have an injury or any other physical inconvenience, always inform your instructor about this before starting the Session.
  3. Listen to and follow the instructions of the person who hosts the Session.
  4. Perform all exercises carefully and bear your physical limitations in mind.
  5. Do not perform any exercises that are painful.
  6. Ask questions if you do not understand an exercise.
  7. Avoid inverted poses during menstruation and strong breathing exercises during pregnancy.
  8. Although we strive to only provide correct information on our website, we are not liable for any inaccuracy and no rights can be derived there from.

Breathwork

  1. When participating in a breathwork session, please mention to the instructor if you have any of the following conditions: Asthma – mild or medium (bring your inhalator!), High bold pressure, History of surgery of physical injury, Thyroid condition, Diabetes – (bring your glucose), History of seizure, PTSD, Bipolar disorder, schizophrenia or psychiatric condition, Actively using recreational drugs or medication that alters brain chemistry.
  2. Do not participate in a breathwork session if you have any of the following conditions: Cardiovascular disease (angina, previous heart attacks, or strokes), Detached retina, Glaucoma, Aneurysm in the brain or abdomen, Kidney disease, Severe Asthma, or Epilepsy.

Hypnosis & Hypnotherapy

  1. Do not participate in a Hypnosis or Hypnotherapy session if you suspect or have been confirmed with Pregnancy, Psychosis, Epilepsy or Schizophrenia.
  2. No guaranteed result will be held accountable to the Hypnotherapist.
  3. Both parties hold the right to terminate the sessions at any time.
  4. As a CAT therapist, we follow the GAT-Wkkgz complaints law and GAT disciplinary law at the Geschilleninstantie Alternatieve Therapeuten (GAT). For more information about my complaints procedure, see: gatgeschillen.nl.

8. Personal Data

  1. MengjiaMindfulness collects the personal data of the Participants to update its participation records, execute payment orders and for administration and information purposes. MengjiaMindfulness handles this collection of personal data with due care and complies with the provisions of the Dutch Data Protection Act.
  2. MengjiaMindfulness uses the personal data to inform the Participants about activities of MengjiaMindfulness and any changes in the schedule. If the Participant does not want to receive communications from MengjiaMindfulness, this person may unsubscribe from the mailing in the bottom of a received newsletter or communicate this to MengjiaMindfulness by sending an email to mengjiamindfulness@gmail.com. The Participant is aware that (s)he cannot use any online services and products of MengjiaMindfulness in that case.
  3. MengjiaMindfulness never gives any personal data of the Participants to third parties without their prior written consent.

9. Governing Law and Dispute Settlement

  1. The General Terms and Conditions are exclusively governed by Dutch law.
  2. Any disputes relating to the General Terms and Conditions, as in Sessions organised by MengjiaMindfulness are settled exclusively by the competent court in Amsterdam or any higher court.

10. Code of Conduct

  1. Participants shall adhere to MengjiaMindfulness’ code of conduct at all times:
  2. Please make sure you are clean and fresh when you attend the yoga class.
  3. MengjiaMindfulness advises not to eat later than two hours before the start of the yoga class/breathwork session and, in any case, not to do these practices on a full stomach.
  4. Please do not wear shoes in the yoga studio or meditation center.
  5. We ask you to bring your own yoga mat and props when possible. When there are props available these may be used.
  6. The physical and mental integrity of Participants must always be respected. Racism, sexual behaviour or sexually suggestive behaviour is not tolerated by MengjiaMindfulness.
  7. MengjiaMindfulness reserves the right to deny access to Participants who do not observe the house rules in MengjiaMindfulness’ premises and to terminate the remaining Sessions of the relevant Participant without a refund of any paid fees.

11. Copyright Clause

  1. The provided material has been accumulated with the utmost care. All materials, including images, text, videos, recordings, presentations, etc. that are provided during the Sessions are protected by Copyright and may not be used or copied without permission of MengjiaMindfulness.
  2. Participants of any Sessions become the owners of the study material. They can use it to study but they are not allowed to sell the study material under a different name or brand.
